These terms govern your use of omconcepts.net and the demonstrations, forms, and agent endpoints it hosts. Custom client engagements are governed by a separate written agreement. Please read both.
Acceptance of terms
By accessing or using this site, you agree to these terms. If you do not agree, do not use the site. If you use the site on behalf of a company, you represent that you are authorized to bind that company to these terms.
Service description
Om Concepts is a Pennsylvania sole proprietorship offering marketing systems, custom software, AI agents, and advisory work for small and mid-sized businesses. This website is a marketing and demonstration surface. It lets visitors read about our services, submit inquiries, download guides, and interact with sandboxed agent demonstrations.
Custom engagements
This site does not form a contract for services. Pricing, timelines, and scope described on the site are indicative only. Every engagement is governed by a separate written engagement letter or statement of work that both parties sign. Until that signed agreement exists, neither party is obligated to deliver or pay for work.
Acceptable use
Our API and agent endpoints are rate-limited and subject to abuse controls. When you use the site, you agree not to:
- Scrape, mirror, or bulk-download site content without written permission.
- Attempt to bypass rate limits, authentication, or other security controls.
- Probe agent endpoints for training data, system prompts, or credentials, or otherwise attempt prompt-injection against our tools.
- Submit content that is unlawful, infringing, defamatory, or that contains malware.
- Impersonate another person or misrepresent your affiliation with a company.
- Use the site in a way that interferes with other users or degrades service availability.
We may throttle, suspend, or block requests that we reasonably believe violate these rules.
Intellectual property
The site, its source code, copy, visual design, and brand marks are © Om Concepts unless otherwise noted. Portfolio entries and case studies are shown with the underlying client's permission. You may share links to public pages and quote short excerpts with attribution. You may not reproduce substantial portions of the site without written permission.
Content you submit through a form or agent endpoint remains yours. By submitting it, you grant Om Concepts a limited, non-exclusive, worldwide license to use, store, and process that content solely to deliver the service you requested, to respond to your inquiry, and to meet our legal and security obligations. We do not use your submissions to train third-party models.
Agent demonstrations
Agent demonstrations on this site are sandboxed, rate-limited, and intended to showcase real capabilities. Outputs are generated by language models and may be incomplete, inaccurate, or occasionally wrong. They are not legal, medical, financial, tax, or other regulated advice, and you should not rely on them for consequential decisions without independent review. We keep a minimized audit record of each demo run to prevent abuse and support accountability.
Disclaimers
Except as required by a signed engagement agreement, the site and its demonstrations are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content. We do not warrant that the site will be uninterrupted, error-free, or secure against every threat.
Limitation of liability
To the fullest extent permitted by law, Om Concepts is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the site or its demonstrations, including loss of profits, revenue, data, business, or goodwill, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or related to your use of the site or its demonstrations is limited to the greater of (a) the fees you paid Om Concepts under any written engagement in the twelve months preceding the claim, or (b) one hundred US dollars ($100). This cap does not apply to (i) our gross negligence or willful misconduct, (ii) claims of bodily injury or death caused by our negligence, (iii) our indemnification obligations below, or (iv) other liabilities that cannot be limited under applicable law.
Indemnification
You agree to defend, indemnify, and hold Om Concepts harmless from third-party claims, damages, and reasonable expenses (including legal fees) arising from your violation of these terms, your misuse of the site, or your infringement of another party's rights through content you submit. We agree to defend, indemnify, and hold you harmless from third-party claims that site content we author infringes their intellectual property rights, subject to the limitations above.
Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
Dispute resolution
If a dispute arises, contact alex@omconcepts.net first. We will try to resolve it informally within 30 days of your written notice. If that fails, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Lehigh County, Pennsylvania. Each party pays its own fees unless the arbitrator awards otherwise. Nothing in this section prevents either party from seeking injunctive relief in a Pennsylvania state or federal court to protect intellectual property or confidential information.
Termination
We may suspend or terminate your access to the site or any agent endpoint at any time, with or without notice, for violations of these terms or to protect the site. You may stop using the site at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law, dispute resolution) survive.
Changes to these terms
We update the “Last updated” date at the top of this page whenever these terms change. Material changes will be announced to people on our list, and continued use of the site after the change means you accept the updated terms.
